Abstract

This work aims to analyze the civil liability of condominiums in cases of domestic violence due to omission, in light of São Paulo State Law No. 17.406/2021, as well as to examine the issue from a sociological perspective focusing on the "Genovese Syndrome". The methodology was based on bibliographic and documentary research, supported by legislation, doctrine, jurisprudence, and data from official bodies, allowing for a critical analysis of the topic. The clarity of the law in imposing a duty on residents and building managers to report episodes of violence was noted, providing sanctions for their inaction in an effort to reinforce the social function of the condominium as a space for prevention and confrontation of aggression. However, a persistent culture of apathy is revealed, hindering the applicability of the law and creating a conflict between the privacy of the home and the protection of human dignity. As a result of the research, it is found that the legal duty of the condominium and its representatives contributes both to the protection of victims and to collective awareness of the need to report such practices. It is concluded that the effective application of the law, combined with the dissemination of information and community engagement, are essential for safer and more supportive condominium environments.
