Abstract: In this paper, the role of the victim and the loss of his leading role in criminal conflicts are studied. At first, through a juridical analysis of the Penal Code and the Criminal Procedure Code in force, it is examined how the victim had his rights forgotten, to the point of being considered as a mere witness of the State-Judge. Then, two bills are analyzed (Victim Statute and new Criminal Procedure Code) that aim to overcome the present state of affairs. Finally, it is then studied how the rights of victims are intertwined with restorative justice, researching its current applicability through the non-prosecution agreement.
