Reflections on Restorative Justice in post-war contexts/internal and external conflicts involving nations

This article aims to promote reflections on conflict resolution approaches in post-war contexts, as well as reflect on whether/how politics can influence the development and implementation of Restorative Justice in these contexts. To this end, we analyzed cases in which approaches were used that, although not purely restorative, have aspects that dialogue with Restorative Justice and other alternative means of resolving disputes. In the cases reported in this article, we can see the efforts made towards the search for consensus, involving strategies aimed at each reality, to maintain peace in post-war/conflict contexts. It is noted that, although it is a challenging activity, given that, in post-war/conflict contexts, there are deep and sensitive issues to be worked on for the reconstruction of affected human relationships, the efforts made towards establishing justice humanized, can provide opportunities for social inclusion, strengthening the sense of collectiveness and providing co-responsibility, with priority given to the interests of the society involved, acting in a social dimension, to achieve results based on proportionality and the reasonableness of the obligations assumed. The proposal was to analyze the approaches used as a strategy to combat violence in each case presented, and where JR could be interesting as a strategy for maintaining peace and avoiding conflict escalation.
