The importance of applying the Restorative Justice in Cases of Juvenile Homicides

This work of Juridical Sciences addresses the Restorative Justice as an paradigmatic alternative due the traditional penal system, ruled by the repair of damage rather than the mere punishment in cases governed by the brazilian Children and Adolescents Statute (Estatuto da Criança e do Adolescente). Which aims to, in general terms, demonstrate that the Restorative Justice can act in cases involving juvenile adolescent as actors of homicides. Furthermore, especially seek conceptualize and demonstrate the forms of the Restorative Justice, comprehend how the brazilian Children and Adolescents Statute (Estatuto da Criança e do Adolescente) tret them when they are the perpetrators of homicide and point out the application of the same in these cases. For this purpose, a deductive approach was used, attached with the bibliographic method to reach the conclusion that the application of Restorative Justice on cases of juvenile homicides does not represent impunity; but rather, a proposal of justice that sees the development human being as capable of transformation.
