STALKING: THE BEGINNING OF A NIGHTMARE AND THE NEED FOR AN INCREASE IN SENTENCE

This article analyzes gaps in Law No. 14,132/2021, which defines stalking as a crime by adding Article 147-A to the Penal Code. The research explores the psychological and physical consequences for victims, the need for harsher penalties, and the challenges in enforcing the law. Documentary and bibliographic research methods are used to examine the crime’s context, offender profiles, and the urgency of more effective protective measures. It argues that current legislation fails to ensure victim safety and prevent recurrent behavior, emphasizing the need for stricter sanctions.
