Digital violence and its effects on victims: contemporary challenges and the perspective of the digital human being

This article analyzes the phenomenon of digital violence in Brazil, its various manifestations and impacts, as well as the legal framework and public policies developed to combat it. Predominant forms of digital abuse are investigated, such as cyberstalking, spyware surveillance, revenge pornography and defamation on social networks, highlighting their psychological, functional and physiological consequences on victims. The study examines relevant Brazilian legislation, including the Federal Constitution and specific laws, evaluating their effectiveness in the face of emerging technological challenges. Additionally, protection initiatives are discussed, such as emergency applications, digital monitoring and digital education, as well as partnerships between public and private sectors.
The article also introduces the theory of the Digital Human Being, which recognizes the individual as a multidimensional entity — physical, social, biological and digital — and offers a new perspective for the protection of rights in the digital environment. Based on Quantum Law, this theory proposes an integrated and adaptive legal approach, necessary to face the complexities of modern digital interactions. It is concluded that, despite significant advances, the effective fight against digital violence requires a multidimensional and constantly evolving approach, which considers the intersection between the different spheres of human life.
